今有徐新法、陈金娣家庭成员中二子（徐海清、徐海明）均已经成年，准备分家另过独立生活，父母为子女生计考虑，愿将自己所有的财产分与二子为业，为划清产权，避免争议，团结和睦，特立此分家协议书为凭。
一、居住屋分配：现有居住房屋肆间两层，分别分予徐海清和徐海明二人。其中东边两间两层分给徐海清所有，西边两间两层分给徐海明所有；
二、出租屋分配：现有出租房屋，所产生的房屋租赁费用由徐新法、陈金娣夫妇收取并使用。出租房屋所有权暂时不予分配，归徐新法、陈金娣夫妇所有。待徐新法、陈金娣夫妇百年后遵照遗嘱分配或没有遗嘱徐海清、徐海明协商分配；
三、空余土地分配：协议签订之日，没有居住房屋和出租房的空余部分土地，按居住房屋划分界线。徐海清、徐海明二人各50％，东边50％归徐海清所有，西边50％归徐海明所有。双方不得干涉对方改变土地的用途；
四、共同债务分配：家庭共同债务不分配，由徐新法、陈金娣二人偿还；
六、老人赡养：由于赡养徐新法、陈金娣所产生的费用，需要儿子承担的，徐海清、徐海明按各50％的比例分摊；
七、本协议一式四份，经所有当事人签字并芝里社区盖章后生效，徐

鞋帽等个人物品(被赡养人同意不购买的除外)，所需费用由赡养人共同承担。子女保证父母的衣服、被褥干净、整洁，父母单独居住的由当期子女负责，父母同子女共同居住的由同住子女负责
3、子女应为被赡养人提供安全、舒适、方便的居住场所以及其它生活用品。子女应当妥善安排被赡养人的住房，不得强迫被赡养人迁居条件低劣的房屋。父母单独居住的，如房屋损毁，子女应负责及时维修，确保父母的住所不破、不漏，卫生整洁，费用由子女共同承担。
4、子女应保证父母为满足日常需要自由出行的权利，所需交通费用由子女共同分担。如驸马爷不能自行出行，子女应安排时间负责父母出行，所需交通费由当期子女承担。父母需要添置轮椅的，子女应及时购买，所需费用由赡养人共同承担，当期子女应经常陪同父母到户外活动。
