为方便业务洽谈需要，在遵循互惠互利的原则的基础上，经协商同意后，特拟定合同条款如下：

1.
合作内容
由甲方办理乙方的宠物由___北京__(以下简称出境地)前往_____奥地利_____（以下简称目的地）的出境手续，并负责确保宠物符合目的地的入境要求；
乙方需向甲方交付健康、正常的宠物，并对宠物的健康状况负责。具体宠物信息、宠物体形测算及声明事件见附件;
以下所指‘乙方宠物’特指附件当中所列乙方交付甲方负责运送到目的地的_壹_只宠物。

the

shall
deliver
a
healthy
and
right
pet,and
responsible
for
the
pet’s
health.
Detailed
pet
ination,pet
figure
calculate
and
statement
events
see
annex;
Below
mentioned
“Party
B’s
pet”
refers
in
particular
to
one
pet
which
listed
in
annex
that
the
Party
B
delivered
to
Party
A
to
transport
it
to
the
destination.
2.
宠物运送的具体安排
2.1
甲方负责将乙方的宠物安全送到目的地；在乙方通知接收宠物后3个工作日内，将宠物从厦门托运至香港。
2.2
甲方负责乙方宠物在香港的食宿、医疗、监护。并在中转地负责办理宠物入境纽约所需必要的检验、检疫、文书处理、报关报检等手续；
2.3
甲方全程负责给乙方宠物预定宠物航班、出境的宠物报关以及支付宠物航空运输费和健康体检等其它相关费用；
2.4
乙方应按时给甲方交付健康、正常的宠物，积极配合甲方工作，及时提供甲方办理宠物托运所需的文档资料，个人及宠物信息等。

2.1
Party
A
is
responsible
for
the

delivery

pet;
within
three
working
days
after
the
Party
B
receives
the
notification,transport
the
pet
from
Xiamen
to
Hongkong.
2.2
Party
A
is
responsible
for
the
pet’s
board
and
lodging,medical
treatment,custody
in
Hongkong.
And
responsible
for
dealing
the
necessary
procedures
of
inspect,quarantine,word
processing,customs
clearance
and
inspection
declaration
etc.
in
transit
depot
when
pet
entry.
2.3
Party
A
is
responsible
for
Party
B’s
pet
flight
booking,pet
exit
customs
clearance
and
pays
the
pet’s
air
transportation
and
healthy
check-up
fee
and
other
related
fees
in
the
whole
journey.
2.4
Party
B
should
deliver
the
health
and
right
pet
to
Party
A
on
time,match
up
Party
A’s
work
actively,and
supply
the
data
and
ination
of
the
person
and
the
pet
which
will
be
used
in
pet
transportation.
3.
责任义务
3.1
甲方对乙方宠物从出发地到目的地的期间的安全和健康负责；
3.2
甲方负责乙方宠物入境目的地的所有手续；乙方负责宠物到达目的地后的所有费用；乙方宠物因为血液检测结果不合格、本身身体状况的原因需要治疗或重新检测的费用需要乙方支付。
3.3
甲方负责对“不可抗力”和因以下几种因素而造成不能达成合同要求的情况不承担责任：
A、
不可抗力（包括但不限于如地震、海啸、战争、动乱）
B、
宠物血样检测结果不合格；
C、
宠物因先天性疾病而造成不适合或被拒绝入境；
D、
宠物因年老而造成的死亡；
E、
宠物在航空飞行当中因航空意外的死亡；
F、

3.4甲方对乙方宠物非3.3中所列因素造成的不能达成合同目标时，应退还乙方未完成阶段的服务费用，如造成宠物死亡或失踪的情况负赔偿责任；
3.5
乙方对延误付款造成的损失负责，并需支付甲方违约金。

all
the
procedures
of

B’s
pet
entry;

B
is
responsible
for
all
the
fees
of
the
pet
to
the
destination;
when
Party
B’s
pet
blood
test
result
substandard,its
physical
condition
needs
treatment
or
need
to
re-testing,the
fee
should
be
paid
by
Party
B.
3.3
Party
A
is
not
responsible
for
force
majeure
and
the
following
conditions
that
caused
by
the
factors
and
cannot
reach
the
contract:
A
、Force
majeure
(including
but
not
limited
to
earthquake,tsunami,war,turmoil)
B
、The
pet’s
blood
test
substandard;
C
、Congenital
disorders
of
the
pet
causes
the
unsuited
or
refused
to
entry;
D
、Pet’s
death,due
to
old
age;
E、
Pet’s
death
in
aviation,due
to
aviation
accidents;
F、
Party
B
does
not
fulfill
payment
obligation
or
not
promptly
provide
the
necessary
ination
for
Party
B’s
pet
exit;
3.4
If
Party
A
cannot
reach
the
contract
not
owing
to
the
reasons
listed
in
term
3.3,it
should
return
the
uncompleted
service
fee,if
cause
the
death
or
miss
of
the
pet,it
should
bear
liability
for
damage;
3.5
Party
B
is
responsible
for
the
loss
of
delay
payment
and
pay
the
penal
sum
to
Party
A.
4.
宠物运送费用及支付方式。
4.1
乙方需支付给甲方的宠物运送费用总计为人民币

4.2
运送费用分二部分支付，第一部分款项为合同总金额的50%，应于签订合同时付清；第二部分款项为合同总金额的50%，在乙方宠物办理完所有入境文件且取得入境纽约的条件后，于宠物起飞前支付；

支付方式：乙方可用现金或银行卡直接向甲方支付，或将款项付给甲方指定的代理银行账户或公司账户（乙方需妥善保留汇款的凭证作为支付款项的凭证）；

4.1

the
conditions
of

4.3
Payment
term:

can
pay

by
cash
or
by
card,or
pay
the
amount
to
the
agent
bank
account
or
company
account
appointed
by
party
A

keep
the
payment
certificate
as
the
remittance

5.
违规责任
1、
乙双方应严格履行本合同约定条款，如任何一方违约，违约方应向守约方支付
违约金并赔偿损失。
5.1违约金：任何一方违约，违约方应向守约方支付“约定运输费用”总额20%的违约金，合同中另有约定的除外；
5.2
损失赔偿：违约方应向守约方支付由于违约给对方造成的实际损失。
5.
Violation
responsibility
The
two
parties
shall
strictly
fulfill
the
terms
of
this
contract,if
any
party
defaults,the
defaulting
party
shall
pay
penal
sum
loss
compensation
to
the
observant
party.
5.1
Penal
sum:
any
party
breaches
of
the
contract,the
defaulting
party
shall
pay
20%
of
“agreed
transport
fee”
to
the
observant
party,unless
otherwise
stipulated
in
the
contract.
5.2
Loss
compensation:
the
defaulting
party
shall
the
observant
party
the
actual
loss
due
to
default.
6.
合同纠纷的解决
本合同在履行过程如果发生纠纷，甲、乙双方应协商解决，协商不成的，均可向甲方所在地人民法院提起诉讼。
6.
Contract
disputes
If
dispute
occurred
in
the
course
of
pering
the
contract,the
two
parties
shall
resolve
through
negotiation,if
fail
to
negotiate,each
of
the
party
can
apply
to
the
party
A’s
local
people’s
court.
7.
其他事项
7.1
本合同未尽事宜，甲、乙双方另可补充协议，补充协议与本合同具有同等法律效力。
7.2
本合同自双方签署之日起即时生效。
7.3
本合同一式两份，甲、乙双方各执一份。

Terms

covered
in
this

complement

agreement,the
supplemental
agreement
together
with
the
present
contract
has
the
same
legal
effect.
7.2
This
contract
takes
effect
once
the
two
parties
sign
it.
