第一条
为了加强我市防汛抗旱项目建设及专项经费管理,提高资金使用效益,依据《中华人民共和国预算法》、《中华人民共和国防洪法》、《中华人民共和国防汛条例》、《中华人民共和国抗旱条例》、《特大防汛抗旱补助费管理办法》等有关规定,制定本办法。
第二条
市防汛抗旱资金,是指由市级财政预算安排,为保证防汛抗旱工作有序、高效运行,而用于防汛抗旱工程和非工程系统的应急加固除险和水毁修复,以及用于遭受水旱灾害而开展防汛抗洪抢险或抗旱的专项资金。
第三条
防汛抗旱项目是指为保证大连市防汛抗旱体系(水利部门管辖范围内的防汛和抗旱工程措施和非工程措施)的完整和适用功能而进行的建设、维护运行、加固除险及修复治理。
第四条
在遭受严重水旱灾害时,区市县(先导区)财政部门要积极筹措资金,增加防汛抗旱资金投入。确有困难的,可向市财政和大连市防汛抗旱指挥部办公室(以下简称“市防办”)申请防汛抗旱专项补助资金。
第五条
防汛抗旱资金的分配与使用管理,要体现防汛抗旱应急机制的要求,体现以人为本的防灾救灾理念,突出政策性、及时性和有效性。
第六条
本办法适用于大连市境内申请防汛抗旱资金的防汛抗旱项目。
第二章
专项资金使用范围
第七条
防汛抗旱资金中用于防汛的支出,主要是用于防汛抗洪抢险,以及为保障安全度汛而进行的工程和非工程措施的建设。
一、防汛工程措施:涉及到防汛安全的水库、河道、堤坝、重要海堤及涵闸、泵站等的应急加固和水毁修复。
二、防汛非工程措施:水文测报设施设备,防汛通讯设施的修复,防汛调度指挥、洪水预警预报、山洪灾害防治等各类与防汛相关的系统建设与维护,各类防洪预案、洪水风险图的编制;防汛抢险队伍建设、防汛抢险演练;防汛物资及设备购置、储备及管理费用。
三、防汛抗洪抢险专项经费具体开支范围:
(一)在防汛抗洪抢险期间,参加现场防汛抗洪抢险和组织群众安全转移的人员伙食费用;
(二)抗洪抢险所需物资材料的紧急购置费用;
(三)临时购置用于巡堤查险、堵口复堤、水上救生、应急监测、预警预报等小型专用设备的费用,以及为防汛抗洪抢险租用专用设备的费用;
(四)临时架设租用报汛通信线路、通信工具及其维修的费用;
(五)水文、雨量测报费用,以及为测报洪水临时设置水文报汛站所需的费用;
(六)租用及调用运输工具所发生的租金和运输费用;
(七)动用的各类机械的燃油料、台班费及检修费和租用费;
(八)耗用的电费和临时防汛指挥机构在发生特大洪水期间开支的临时办公经费等。
下列各项不得在市级防汛补助费中列支:
(一)已列入年度河流达标治理规划范围内的河道整治费用;
(二)工矿、铁路、公路、邮电等部门应急度汛项目费用;
(三)城市新建防洪工程项目;
(四)灌溉渠道、渡槽、平塘等农田水利设施的水毁修复费用;
(五)列入基本建设计划项目的在建水利工程水毁修复及应急度汛所需经费;
(六)项目涉及的征地、动迁等费用;
(七)其他应在部门预算中安排的经常性防汛业务经费。
第八条
防汛抗旱资金中用于抗旱的支出,主要用于补助遭受严重干旱灾害的区域旱情监测,兴建应急抗旱水源和抗旱设施,添置提运水设备及运行的费用。
抗旱资金具体开支范围:
(一)抗旱设备添置费。因抗旱需要添置水泵、汽(柴)油发电机组、输水管、找水物探设备、打井机、洗井机、移动浇灌、喷灌滴灌节水设备和固定式拉水车、移动净水设备、储水罐等抗旱设备发生的费用;
(二)抗旱应急设施建设费。因抗旱需要应急修建的泵站、拦河坝、输水渠道、水井、塘坝、集雨设施等费用;
(三)抗旱用油用电费。抗旱期间,采取提水、输水、运水等措施而产生的油、电费用;
(四)抗旱设施应急维修费。抗旱期间,抗旱设施、设备应急维修发生的费用;
(五)旱情信息测报费。抗旱期间临时设置的旱情信息测报点及测报费用;
(六)市级抗旱物资储备费用。市防办购置、补充、更新市级抗旱物资及储备管理费用;
(七)其他费用。抗旱新技术新产品示范、推广费用。
下列各项不得在抗旱补助费中列支:
(一)正常的人畜饮水和乡镇供水设施的修建费用;
(二)印发抗旱资料、文件等耗用的宣传费用;
(三)各级抗旱服务组织的人员机构费用。
第三章
项目申报
第九条
防汛抗旱工程项目原则上要立足于工程现状,维护工程的原有规模标准不改变、不扩大,如确需改变或扩大时,要进行专门论证,并按管理权限报批。
第十条
区市县(先导区)水行政主管部门须按照大连市防汛抗旱指挥部统一部署,以确保防汛工程正常运行、安全度汛为原则,按照轻重缓急、科学合理地确定防汛度汛的申报项目。
第十一条
区市县(先导区)水行政主管部门于每年10月20日前,在完成勘察设计的基础上,由区市县(先导区)财政、水利部门联合向市财政局、市防办申报。
市水务局所属单位申请防汛抗旱专项经费,在完成勘察设计的基础上统一报送市防办。
区市县(先导区)水行政主管部门须对项目的合规性、合法性负责。
市防办负责组织有关单位、专家于11月底前完成对申请下一年度需市补的防汛抗旱项目设计方案进行审查认定,在报请大连市防汛抗旱指挥部(以下简称“市防指”)批准后,将申请项目计划报送市财政局。由市财政局委托市财政投资审核中心于项目实施当年3月份前完成审定项目投资额度工作,并根据审定后的投资额度作为确定项目补助资金依据,按照补助比例下达财政补助资金投资计划。
水毁修复工程的申报需满足工程损毁是由于洪水、暴雨引起,险(灾)情即将发生、正在发生或已经发生并趋向扩大化,不立即采取紧急措施排除险情将给人民生命财产造成较大损失的工程项目,由当地水行政主管部门提出认定初步意见,并上报市防办,由市防指研究审定。
区市县(先导区)需市补的防汛度汛非工程措施项目的申报要以为确保防洪安全、保障人民生命财产安全为原则,由区市县(先导区)水行政主管部门组织上报。原则上只允许上报涉及所在区市县(先导区)全域防汛保障的非工程措施项目。
第十二条
防汛度汛项目申报须包括以下内容:
(一)工程初步设计;
(二)工程待维修部位的影像照片;
(三)其它资料。
第十三条
项目建设单位要严格按照项目申报程序组织项目申报方案,项目一经上报,不得擅自变更或调整,确需变更或调整的,须按原审批程序报批。
第四章
投入政策和资金管理
第十四条
防汛抗旱资金的使用原则及重点:
(一)事权与财权统一的原则。防汛抗旱项目按照事权、责权划分,由市、县、乡及经营管理单位分级管理、分级负责,并同时承担相应的行政法律责任。市政府直接管辖的防汛抗旱项目资金主要由市政府承担,区市县(先导区)级政府管辖项目,市财政予以一定补助。
(二)突出重点,量力而行原则。在项目安排上,应先做好规划,同时要量力而行,按照轻重缓急,优先安排与人民生命财产安全和农民生产生活条件密切相关的项目。
第十五条
按照“分级管理,分级负担”的原则,并根据区市县(先导区)财政状况及建设任务等因素综合考虑,防汛抗旱项目投资实行分级承担和差别化政策,即市本级防汛抗旱项目所需资金由市级财政全额负担;“北三市”及长海县项目市财政按照投资额70%补助,“南三区”及先导区项目市财政按照投资额60%补助,其余部分由各区市县(先导区)及县以下财政、管理单位自筹解决。
第十六条
防汛抗旱资金主要用于本办法第七条、第八条规定的项目支出。
第十七条
项目业主应严格按照批准的工程建设内容使用建设资金,并按照财政专项资金管理办法,实行专款专用。对不按规定使用工程建设资金的,各级水行政主管部门及财政部门有权终止项目执行,并由财政部门将资金收缴国库。对违反财政纪律的项目单位和负责人,将按照《财政违法行为处罚处分条例》的规定进行处理,涉嫌犯罪的移送司法机关处理。
区市县(先导区)财政部门要对项目资金使用实行全程监管,及时拨付建设资金。
区市县(先导区)防汛抗旱项目由财政部门会同水行政主管部门对补助费使用管理情况进行监督检查,对检查中发现的问题,及时上报市财政局、市防办。
第五章
建设管理
第十八条
防汛抗旱项目建设由各区市县(先导区)水行政主管部门负责组织实施。
第十九条
防汛抗旱项目原则上实行招投标制,凡符合招标条件的防汛抗旱项目,应根据《水利工程建设项目招标投标管理规定》、《大连市水工程施工招标投标管理办法》以及《中华人民共和国政府采购法》等相关规定进行公开招投标,对特殊情况(如汛期突发的急需修复的抢险工程、物资购置等)不能实行招标的防汛抗旱应急工程及防汛度汛非工程措施项目,须经区市县(先导区)防汛抗旱指挥部审批后,报市防指、财政局备案。市本级不能实行招标的防汛抗旱应急工程及防汛度汛非工程措施项目须经市防指批复后方可实施。
第二十条
防汛抗旱项目招标投标监督管理由项目所在区市县(先导区)水行政主管部门负责。
第二十一条
防汛抗旱项目实行合同管理制。项目建设单位必须严格按照相关法律、法规与工程设计、监理、施工、设备供应商签订建设工程合同或委托合同。
第二十二条
防汛抗旱项目建设单位在开工前,应向水利质量监督机构办理质量监督申报手续,填写《水工程质量监督申请书》,并提供所需材料,接受水工程质量监督机构对其工程质量进行监督。
第六章
项目验收
第二十三条
项目建设单位必须按照批复文件规定的期限完成各项建设内容。项目完工后,应持《水工程质量核定申请书》和所需材料到质量监督机构办理质量核定手续,并按规定完善整理竣工资料、完成竣工决算后,向区市县(先导区)水行政主管部门提出验收申请。
区市县(先导区)水行政主管部门按照有关规定及时组织相关单位和专家进行项目验收。
第二十四条
区市县(先导区)水行政主管部门项目验收后,将竣工验收专项报告上报市防办、市财政局。在区市县(先导区)验收的基础上,市防办组织相关部门人员、专家将对区市县(先导区)的验收结果进行抽查,检查不合格的限期整改。整改不到位的,将核减当年防汛资金补助指标。
第七章
附则
第二十五条
本办法由市防办、市财政局负责解释。
第二十六条
本办法自发布之日起施行,原大连市财政局、大连市水务局《关于修订的通知》(大财农〔2008〕368号)中涉及防汛度汛应急工程资金管理部分条款废止执行。
